The Bank of America is now suing Ducktown Dodge in Polk County and Eric Brucker for loan default and fraud.

According to federal court documents, not only did they fail to pay the note, Bank of America says Brucker misrepresented his company's financial condition.

He eventually sold the bank's collateral, which was the vehicle inventory. The Bank claims to be out at least a million dollars.
