Rutherford Maintains Innocence In Child Murder Trial

The jury heard another tense interview in the murder case of Brian Rutherford.

   Detectives accuse him of killing 18 month old Sierra Carpenter back in April of 2006. She was the daughter of his girlfriend, Traci Carpenter.

   Rutherford told detectives she went into a seizure a day after throwing up. He and Carpenter rushed the child to a nearby fire station.

   At T.C. Thompson Children's Hospital, doctors say the child's brain swelled from abuse...and Sierra later died.

Detective Brian Ashburn told Rutherford he was going to charge him for her death because of a timeline putting him alone with the little girl and different stories to different people.

But Rutherford stood his ground during the interview. "I know in my heart, I guess I'll have to do what it takes to prove my innocence. I know. I know 150 % I did not do this," Rutherford told Detective Ashburn.

   Prosecutors say Traci Carpenter is expected to take the stand but has yet to do so.
