Recall Battle Lines Set

The recall battle of Mayor Ron Littlefield unfolded in court this morning. Circuit Court Judge Jeff Hollingsworth ruled the legal conflit will happen in Circuit Court, not Chancery Court as those behind the recall wanted.

And Jim Folkner, the man behind Citizens To Recall Littlefield, now stands in the legal fight. Initially, the Election Commission, Mayor Littlefield and the City of Chattanooga were the only parties.

Although signers met the City Charter required number of signatures threshold, a technicality could toss many of them out. Mayor Littlefield's attorney, Hal North, explained.

North said, "The law specifically requires that the signatures be dated. We understand the Election Commission has now admitted over half of them or over five thousand are undated."

Folkner said the signatures were gathered in good faith and should stand. Circuit Court will decide that issue on Tuesday.
