The second suspect in a murder of a 70-year-old man in 2005 will not have to go to jail for his role in the crime.

Bryant Cannon, who was 15-years-old at the time of John Calvin Smith's death pleaded guilty to a lesser charge of facilitation to commit second degree murder and received an eight year suspended sentence.

Police say Smith was shot twice inside his Olive Street home in Chattanooga.

Cannon's co-defendant, Aaron Johnson took a plea in September and also received a nine year suspended sentence.

Both Cannon and Smith originally faced especially aggravated burglary, especially aggravated robbery and first degree premeditated murder charges.
