A Whitfield County judge arraigned aspiring model and singer, Skyy Mims, of Detroit, on murder and armed robbery charges Monday.
Mims, 21, is accused of stabbing and killing gas station clerk DK Chaudhari, 37, at Kanku's Express on March 9. Mims was arrested two days later in Bartow County, police said.
Judge Jack Partain's courtroom was filled with emotion and determination to prove that Skyy Mims is innocent. Her family and attorney said Mims is a stellar person not capable of murder.
"She's never been in trouble in her life," one family member told NewsChannel9. No representatives for the victim appeared in court.
Mims' attorney Carla Marable, of Michigan, said she plans to prove the case is circumstantial and has no evidence. She said she found the person who is a "dead ringer for Skyy," and Marable said that's who you see in surveillance video, not Mims.
"I believe that Miss Skyy is totally misidentified. It's someone else and I'm going to prove that," said Marable, adding that Mims was in Georgia visiting friends at that time. "Atlanta's the hot spot. She was in her way there to try to get started in the music industry. She came to visit some friends in this area and this happened."
But authorities said Mims is the person pictured in the video. Since her indictment, Mims has been in jail without bond. Her attorney tried to change that by asking for a bond amount; however, Partain denied it, saying Mims has no ties to the area and would be a flight risk.
"The mother is very concerned because her baby's only 21-years-old. So, she's trying to move into this area," said Marable. "I will renew the issue of bond as soon as the mother makes residency here."
Mims waved to her family before disappearing behind the court doors once again.
"We just want the truth to be known. She's innocent. She's innocent," another family member said.
Marable said Mims has not been a troublemaker in jail.
The judge set her trial date for November 3.
